Plaintiff’s petition set out the written order for services or contract under which defendant agreed to transport the household goods of plaintiff from his old home in Sioux City to his new home in Palo Alto, California, with “reasonable dispatch.” In compliance with a ruling of the court made on defendant’s motion, the petition was amended to allege that the agreement to deliver the goods within a reasonable time was oral and was made with Leo Wilson, the Sioux City agent of defendant, and another employee of defendant.
