Appeal from a judgment of the superior court for Spokane county, Kennan, J., entered November 21, 1912, upon the verdict of a jury rendered in favor of the plaintiff, in an action in tort.

The plaintiff alleges facts in his complaint upon which he seeks recovery of damages from the defendants, as follows: For his first cause of action:
“That defendants on May 27, 1912, in the county of Spokane, state of Washington, committed an assault upon the plaintiff and did beat, bruise, and injure the plaintiff, and did also use vile and abusive language of and toward plaintiff by reason of which plaintiff has suffered damages in the sum of ten thousand ($10,000)”;
and for a second cause of action:
“That the defendants on May 27, 1912, in the county of Spokane, state of Washington,…
