This case was previously before this court at the October term, 1937. It is here on a second appeal. In order to properly understand the situation in the present appeal, it is necessary to understand the facts involved in the first appeal. This result can be had by a reference to the former opinion as easily as attempting to restate same here. Since the former case [294 Ill.
