Defendant-Appellant-Cross-Appellee William Balsámico (“Balsámico”) appeals from a judgment entered January 21, 2005, following a jury verdict in the United States District Court for the Northern District of New York (David N. Hurd, Judge).

The jury found Balsámico liable to Plaintiff-Appellee-Cross-Appellant Michael Antonio Patterson (“Patterson”) for intentional infliction of emotional distress, and for having created a racially hostile work environment by participating in a workplace assault on Patterson.
