Appellants appeal from an adverse jury verdict in this wrongful death action. They raise three errors on appeal: (1) that the Georgia Guest Passenger Rule is unconstitutional; (2) that the district court erred in sending the issue of intervening cause to the jury; and (3) that, in any event, the court erred in refusing their instruction on intervening cause. We find no merit in the first two alleged errors but agree with the appellants that the district court erred in refusing to give their requested instruction. We affirm in part, 484 F.Supp. 616,…
