Marshall, Judge.

Contrary to his plea appellant was indicted, tried and convicted of aggravated assault. He was sentenced to serve eight years in the penitentiary. The transcript reflects that appellant and a friend were standing in between bus stops on one of the City of Atlanta’s MARTA bus lines. The victim of the assault was the driver of one of the MARTA buses. As the bus approached appellant Cloud, he waved at the driver indicating he wished to be picked up.
