BAKER, Judge. —

The appellant was convicted of manslaughter, and his punishmjent assessed at two years in the penitentiary.

The record discloses that the appellant was charged by indictment with the oifense of murdering Ed Barnes on or about February 7, 1926, and was convicted of manslaughter. It was the contention of the state that the deceased and appellant became involved in a controversy over a game of cards, and that appellant shot and killed deceased without provocation and while deceased was unarmed.
