This matter comes before the surrogate on the judicial settlement of the account of the administrator with the will annexed. The estate consists entirely of personal property. The amount to be distributed is $1,319.28.
It seems to be agreed by all the parties cited that a con*254struction of the will of Margarethe Hinners is necessary before any decree on the accounting may be entered. All the parties in interest and next of kin are now before the court, as they -were on the probate of the will.
