OPINION AND ORDER-

MARK S. DAVIS, District Judge.

This matter is before the Court on the motion to dismiss, or in the alternative, motion for summary judgment, filed- by defendant John E. Potter, Postmaster General of the United States Postal Service (“Defendant”). The motion has been fully briefed and argued before the Court. For the reasons stated below, the Court GRANTS summary judgment to Defendant, and the complaint is DISMISSED WITH PREJUDICE.
