WILLARD, District Judge.
This case has been here before. The defendant and appellee the State Savings Bank demurred to the bill. .The demurrer was sustained. Judgment was entered dismissing the bill as to the State Savings Bank. The plaintiff and appellant, the National Surety Company, appealed to this court. The judgment was reversed.
