The defendants áre copartners under the name of Spader & Perkins, engaged in the stock and bond brokerage business, having an office in Ellicott Square building in this city. The Commonwealth Trust Company is a domestic corporation. It appears that, on or about the 6th day of July, 1903, ten shares of the capital stock of said trust company of the par value of $100 each were issued to Mrs. Fannie M. Eaton, and that she has at all times been the lawful owner and holder of said shares of capital stock, which are represented by certificate Ho. 50. This certificate she paid for by check to the…
