SUMMARY OF FACTS AND PROCEDURAL HISTORY

Respondent Jennie Switch sustained an injury while working for petitioner Wal-Mart Stores, Inc., and filed a claim for workers’ compensation benefits. At the hearing, the parties stipulated that Switch had worked at her job an average of seven hours per day, five days a week for approximately two years. They also stipulated that during the year preceding her injury, Switch was paid at the rate of $4.65 per hour for the first 36 weeks, $4.85 per hour for the next six weeks and $5.35 per hour for the last ten weeks.
