POEEENBARGER, JUDGE:
This is a writ of error to a judgment of the criminal court *677of Cabell county, sentencing Ben Strayer to confinement in the penitentiary of this State for life, under a conviction on an indictment for the murder of Sam Benedict.
Some of the assignments of error are predicated upon rulings of the court as to evidence. One is the overruling of a motion to set aside the verdict, as being contrary to the law and the evidence.
