—Order unanimously modified on the law and as modified affirmed without costs in accordance with the following Memorandum: Plaintiffs commenced this action to recover damages for injuries sustained by Douglas F. Rissel (plaintiff) while he was working on the construction of a pipeline. Plaintiff was injured when a section of pipe that was being hoisted approximately three feet off the ground by a boom' attached to a bulldozer/tractor dropped and fell on him.
