A. INTRODUCTION AND PROCEDURAL HISTORY

The instant adversary proceeding involves an Objection filed by PATRICIA SMITH, the Debtor-mortgagor (hereinafter referred to as “the Debtor”), to a Proof of Claim filed by the Defendant, her mortgagee, THE KISSELL COMPANY (hereinafter “the Mortgagee”). We follow our own recent previous decisions in disallowing that portion of the claim seeking postTjudgment interest at the contract rate and permitting the Debtor to recoup a penalty for violations of the federal Truth-in-Lending Act, 15 U.S.C. § 1601, et seq.…
