Appellant was prosecuted and convicted of perjury, his punishment being assessed at two years confinement in the State penitentiary.

Appellant had brought suit in the District Court of Hunt County, Texas, against the M., K. & T. Ry. Co. for damages, alleging that he was injured while in the employ of said company.
