This is an action to recover real estate, situated in the 'city of Seattle. The plaintiff claims to be the owner in fee-simple, designing his'title by mesne conveyances from a patentee of the United States. The defendant is in possession, having entered in the year 1886, claiming title ’by virtue of a tax-deed to him executed by the sheriff pursuant to a sale of the land in 1883 to H. J. Jacobs for a delinquent tax *267for the year 1882.
