Appellant, J. A. Whaley, was arrested on a warrant issued by a police magistrate of the City of Benton charging him with driving a motor vehicle for hire on January 15, 1922, within the corporate limits of that city without a city license. On the trial a jury found him guilty and a fine was assessed against him in the sum of $25. He appealed to the circuit court of Franklin county where a jury was waived and the case tried before the court. That court, in the judgment entered in this matter, found that appellant was not a resident of the City of Benton, but adjudged him guilty of the offense…
