This is an appeal by the plaintiff from a judgment entered in favor of the defendants and from the order denying a new trial. The action was instituted by the plaintiff to recover a balance upon two promissory notes claimed to be due the plaintiff as indorsee. The complaint is in the usual form. All of *545the defendants were served and answered in the case, excepting H. E. Eldridge, who is a nonresident of the state.
