Appeal from an amended judgment of the Supreme Court (Mugglin, J.), entered July 24, 1987 in Delaware County, which dismissed petitioner’s application, in a proceeding pursuant to CPLR article 78, to review a determination of the Zoning Board of Appeals of the Town of Sidney denying petitioner’s request for a use variance.
