In an action to recover damages for personal injuries, the plaintiff appeals, as limited by his brief, from so much of an order of the Supreme Court, Kings County (Schmidt, J.), entered December 10, 2001, as granted those branches of the separate cross motions of the defendants Luigi Caliendo & Sons, Inc., and Nurge Avenue Holding Co., which were for summary judgment dismissing the complaint insofar as asserted against them. *369Justice Townes has been substituted for the late Justice O’Brien (see 22 NYCRR 670.1 [c]).
