¶ 1. After taking a final exam, Ashley Hankins was crossing Fifth Avenue on the campus of Delta State University (DSU) in the City of Cleveland, Mississippi (City), when she was struck by a vehicle driven by Carl Towles.1 Hankins suffered multiple injuries as a result of the accident. On February 25, 2009, Hankins filed a corm plaint against the City, DSU, and Towles in the Bolivar County Circuit Court to recover for her injuries.
