MORROW, Presiding Judge.
— The offense is murder; punishment fixed at confinement in the penitentiary for a period of twenty-five years.
The facts are not materially different from those set out on the former appeal (89 Texas Crim. Rep., 544, 232 S. W. Rep. 845) save in the particulars mentioned hereinafter in connection with the bills of exceptions.
