The Court has under consideration a motion filed on April 22, 2003 (“Motion”), on behalf of what is referred to as an “unofficial unsecured creditors’ committee” comprised of retirees (“Retirees”) of Ag-way, Inc. (“Agway” or “Debtor”). The Motion seeks the appointment of a Committee of Retired Employees pursuant to §§ 1102(a)(2) and 1114(d) of the Bankruptcy Code, 11 U.S.C. §§ 101-1330 (“Code”). Opposition to the Motion was filed on behalf of the United States Trustee (“UST”) on April 30, 2003.…
