This is an appeal from judgment entered April 5, 1923, for want of a sufficient affidavit of defense to a municipal claim for street paying. The claim was filed pursuant to the Act of June 4, 1901, P. L. 364: Scranton v. Genet, 232 Pa. 272. By section 20 (P. L. 372), facts averred in such claims are conclusive unless specifically denied by the affidavit. It appears the city duly caused the street in front of defendant’s property to be paved, and that the claim is for the cost of the paying.
