The appellee John R. Maynes was the owner of a farm of 940 acres, located in Taylor County. Appellee Vernon Maynes is his son. Appellant is a real estate broker.

In the spring of 1921, the son had a conversation with appellant in regard to the sale of said farm, and later, appellant had a conversation with the appellee John R. Maynes, in regard to the sale or trade of said premises. Appellant’s contention is that a contract of exchange was entered into between appellee John R.
