Preliminary Matters

These cases are contracts brought pursuant to the Contract Disputes Act of 1978, 41 U.S.C. §§ 601-613 (1982) (CDA). Defendant has moved to dismiss these actions for lack of subject matter jurisdiction pursuant to Rule 12(b)(1) of the United States Claims Court. The plaintiff vehemently opposes defendant’s motion to dismiss its complaints.
