Christian Gr. and Charles V. Sauer, for whose use this suit was brought and who will hereafter be called appellees, are partners under the firm name of C. Gr. Sauer & Son and engaged in buying and shipping grain, in the Village of Dana, LaSalle county, Illinois. Appellant’s railroad is the only one running through said village. Appellees own a warehouse or grain elevator situated on or near to appellant’s side track in which they receive grain purchased from farmers and from which they load it on ears to be shipped to market.
