OPINION

{¶ 1} Appellant Frankie Graewe, Sr. appeals his conviction, in the Tuscarawas County Court of Common Pleas, on one count of aggravated arson. The relevant procedural facts leading to this appeal are as follows.

{¶ 2} On September 21, 2006, a residence at 449 Center Street, Newcomerstown, Ohio, was destroyed by a fire. Earlier that day, appellant had been evicted from that residence and served with a civil protection order obtained by Bonnie Snively, appellant's live-in girlfriend.
