MULLIGAN, Circuit Judge:
This is an appeal by American Trading and Production Corporation (hereinafter “owner”) from a judgment entered on July 29th, 1971, in the United States District Court for the Southern District of New York, dismissing its claim against Shell International Marine Ltd. (hereinafter “charterer”) for additional compensation in the sum of $131,978.44 for the transportation of cargo from Texas to India via the Cape of Good Hope as a result of the closing of the Suez Canal in June, 1967.
