Appeal from Marshall District Court.- — James W. Willett, Judge. Action for divorce on the grounds of cruel and inhuman treatment. A decree was entered .for the plaintiff, and defendant appeals.

Plaintiff and defendant were married May 1, 1913. At that time, plaintiff was a widower, with adult children, and the defendant had also been previously married. At the time of the trial, the plaintiff was 83 years of age, and the defendant was 66. They had been acquainted with each other two or three years before the marriage. The petition for divorce was filed August 12, 1919, and answer was filed March 24, 1921. Decree was entered in September, 1921.
