OPINION

WERKER, District Judge.

Plaintiff, Joanne Swift, individually, and on behalf of her minor daughter and on behalf of all persons similarly situated, brought this action pursuant to 42 U.S.C. § 1983 and directly under the fourteenth amendment, against defendants 1 seeking declaratory and injunctive relief as well as monetary damages. 2 The complaint alleges violation of plaintiffs’ constitutional rights by defendants’ policy of automatically prorating public assistance grants when an individual who has no legal obligation to support a family receiving Aid to Families With Dependent…
