Appellee commenced an action in the Probate Court of Franklin County for determination of heirship in- the estate of Mary Jane Chennell, deceased. George L. Chennell died testate, without issue, December 11, 1933, leaving all his property to his widow, Mary Jane Chennell, who died testate, without issue, May 9, 1934. At the time of t-he death of Mary Jane Chennell the administration of the estate of George L Chennell had not been completed.
