Defendant has appealed from this court’s order dismissing its exceptions to the trial judge’s findings and verdict in favor of plaintiff in the sum of $7,376, with interest from December 6, 1963. Plaintiff commenced this suit against his insurance carrier to recover moneys paid by him for the care of his son at the Victoria (Texas) Unit of the Devereux Foundation from March 22, 1963, to June 8,1964. The principal question presented is whether or not the Devereux Foundation is a “hospital” within the scope and definition of the insurance policy purchased by plaintiff. Defendant is…
