A suit was originally brought by Rosie Lee Cooper, the then administratrix of the estate of Robert Cooper, *428deceased, against the Railway Company for negligently killing Robert Cooper. It was alleged in the declaration that Rosie Lee Cooper was the widow of Robert Cooper, deceased, and that tbe action was brongbt for the benefit of berself and tbeir minor children. The case was tried to a jury on this theory, Rosie Lee Cooper stating that she was the widow and the five children who were present in court were his children.
