This is an action of trespass on the case for negligence brought to- recover damages for personal injuries alleged to- have been sustained 'by the plaintiff during the unloading of piling from a motor carrier owned by the defendant. The ease was tried to a justice of the superior court- sitting with a jury and resulted in a verdict for the plaintiff in the amount of $30,378.15. The trial justice thereafter denied the defendant’s motion -for a new trial, and the case is before this court solely on the defendant’s exception to the denial of that motion.
