This appeal is from an order sustaining a demurrer to a bill of complaint.

The appellant sought to have the collection of taxes assessed by the City of St. Petesburg upon stated lands for municipal purposes enjoined on the ground that the assessment is illegal because the city was not authorized to make an assessment upon a valuation that exceeds the last valuation made by the State for taxation, as provided by section 1053 of the General Statutes of 1906.
