The action was brought in equity to compel the specific performance of a contract for the sale of real property. On January 16, 1924, a contract was entered into between the plaintiff and the defendant Martena Monroe whereby the latter contracted and agreed to sell and convey to the plaintiff, in consideration of the sum of $8,000, a parcel of real property in the borough of The Bronx, known as 1953 Cedar avenue.
