Folmar Kenner, LLC, petitioned this Court for a writ of certiorari to review the Court of Civil Appeals’ decision reversing the trial court’s sua sponte dismissal, with prejudice, under Rule 41(b), Ala. R. Civ. P., of the counterclaims filed against Fol-mar Kenner by Andra Capaci, doing business as Andra Capaci Real Estate. See Andra Capaci d/b/a Andra Capaci Real Estate v.
