CADENA, Chief Justice.

Appellant asks that we compel the Clerk to file the transcript in this case.

The judgment was signed on June 23, 1980, and appellant timely filed a motion for new trial on July 3, 1980, which was granted on August 14,1980. On September 26, 1980, the trial court entered an order setting aside the order of August 14, 1280, granting appellant’s motion for new trial, and on October 1, 1980, the trial court entered an order overruling appellant’s motion for new trial.
