On June 18, 1922, the plaintiff in error, A. T. Rose, filed this suit against defendant in error, W. W. Clutter, and in his original petition alleged:

“That heretofore, to wit, in the latter part of the year 1920, and during all other times mentioned in this petition, the plaintiff was engaged in the real estate business, buying and selling and trading land as a broker; that the defendant was the owner of 60 acres of land in Cameron county, Tex., and, being desirous of selling the same, listed said land with the plaintiff for sale, and employed the plaintiff to sell the same.
