Petitioner Moses Moore, presently incarcerated and in the custody of the State of Missouri, has filed a petition for a writ of habeas corpus pursuant to 28 U.S.C. § 2254. Petitioner is seeking relief from his 1979 state court convictions for rape and sodomy which resulted in a sentence of 25 years imprisonment. The parties are in agreement that an evidentiary hearing is unnecessary, and the Court concludes that the matter may be resolved on the basis of the existing record.
