The plaintiffs seek to recover the sum of $340, a balance alleged to be due for merchandise sold and delivered. The defendant admits his liability to the extent of $140, but resists payment of the balance of $200 by pleading a discharge of the defendant’s obligation by plaintiffs’ acceptance of notes of a third party, one Robert Hochman.
