The order of the Special Term entered April 30th, 1896, from the affirmance of which this appeal is taken, vacated an interlocutory judgment entered in this action June 27th, 1877, for the partition of real property situated in Queens county, and discontinuing the action. The order was made upon motion in behalf of certain devisees of Garrit Furman, who died June 6th, 1848, and who by his will devised a life estate in the premises to his son William II.
