Appeal from special term. Action by Thurlow VV. Abell and another against Alonzo Bradner and Andrew J. Holden and others. From an order confirming in part and in part overruling the report of a referee, both parties appeal.

The opinion of the court, delivered by Mr. Justice Barker on a former appeal, (11 N. Y. St. Rep. 246,) contains a concise statement of the facts which formed the basis of the interlocutory judgment in this action, and of the principles upon which that judgment was, with certain modifications, affirmed. We refer to that opinion for a statement of the facts and principles of law involved in this case, which are no longer subject to question in this court.
