The appellant was convicted of selling liquor without a license. The indictment was drawn under the Act of May 13, 1887, P. L. 108. That statute is entitled “An Act to regulate and restrain the sale of vinous, spirituous, malt or brewed liquors or any admixtures thereof.” Provision is made therein for the granting, by the several courts of quarter sessions, of licenses to sell liquor on compliance with conditions in the act prescribed and subject to the judgment of the court under the evidence as to the fitness of the person or place and the necessity for such license.…
