MoClintook, J..This action was begun in the Court of Common Pleas of Richland County by Henry J. Fisher against Karl W. Hering. The petition alleges briefly that Peg. Elliott was employed as a waitress at a restaurant known as the Elms at 294 South Diamond street, Mansfield, where food and liquor were served; that Henry J.
