This is a motion on behalf of the defendant for an order to dismiss the complaint herein on the ground that it appears on thé face of the complaint that it does not state facts sufficient to constitute a cause of action, and on the further ground that it appears on the face of the complaint that the court has not jurisdiction of the subject of the action.
