This was an action in assumpsit brought by the plaintiff to recover the sum of $733.98, with interest from July 13, 1922, and the further sum of $2.93, protest fees. It appears from the evidence offered, and which is not disputed, that the defendant had purchased coal from the plaintiff, and that, in payment of this coal, the defendant sent to the plaintiff his check for the sum of $773.98, which cheek has not been paid.
