DICE, Judge.
Appellant was convicted of hunting upon the enclosed lands of another and his punishment was assessed at a fine of $50.
Trial was in the county court upon an indictment returned in the 30th Judicial District Court of McMullen County and by that court transferred to the county court.
The indictment, drawn under Sec. 1(a) of Art. 1377b, V.A. P.C., alleged that on or about the 4th day of November, 1961, in McMullen County, the appellant “did then and there unlawfully enter upon the enclosed land there situated of "another, to-wit, land under the control, care and management of J.
